User's agreement

Please read these terms carefully before purchasing. By placing an order with Feral Interactive, you indicate your agreement to be bound by these terms, as well as confirmation that you are over the age of 16 or that you have permission from a parent or guardian.

In addition, by purchasing from Feral Interactive, you indicate your agreement to any notices (such as website notifications or emails) related to your purchase that you may have received prior to making it.

Please also note that these Terms of Sale do not cover usage of data. Please consult our privacy policy for information on how your data may be used.

Our games

We sell Mac and Linux games via download and physical media. We sell games individually and, in certain cases, as bundles.

We also offer the ability to pre-order our games prior to release. When making pre-order purchases, your credit/debit card will not be charged until your order has been dispatched.

Pricing

The price given on the relevant store page and at checkout is the price you will be charged. Prices may vary over time, and we may run offers that change prices depending on various factors, including your purchase history with us or the site that you were referred from.

We trade in four currencies: Pounds Sterling if you're based in the UK, Euros in Continental Europe, Yen in Japan and US dollars in all other territories. The currency you are purchasing in will be made clear at checkout.

In all EU countries (including the UK), VAT is charged and included in the displayed store prices. Outside the EU, we neither charge nor include sales taxes.

Restrictions of sale

In some territories, some games may not be available due to legal or licensing reasons. In some territories we may sell an altered version of the same game to meet legal or licensing requirements. In all cases, this will be made clear before a purchase can be completed.

Delivery of goods

Where available, you will be offered a choice between purchasing a DVD copy of a game, which we will ship to you, or a downloadable version that is delivered directly to your computer.

If you choose to download a game, we will email you:

  • A URL. This is a link to the .dmg that contains your game and its associated documentation, such as the manual.
  • A product key. This is a unique code required to "activate" your game once you have downloaded it.
  • If you choose a boxed (DVD) copy, you will receive:

  • A DVD box (including inlay), holding the game disc or discs along with the game manual. This is delivered by post.
  • A product key. This is a unique code required to "activate" the game and is printed on the back of the manual.
  • DVD copies are delivered to countries outside the UK by air mail, but please be aware that we can only deliver to certain regions - consult the Feral Web Store Help page for a full list of supported regions. If you live in a country outside these regions, you will only be able to purchase our games via download.

    All physical copies are delivered by regular postal service and not by courier service.

    Customs

    When ordering games to be delivered outside the EU, you may be subject to import duties and taxes imposed by your country. Feral Interactive is not liable for, nor in control of these charges, which must be borne by you.

    Returns, refunds and replacements policy

    You may return any boxed items purchased from the Feral Store for a full refund (not including postage costs) in two cases. Firstly, if you just change your mind, you must notify us within 7 days of receiving the game and return it to us unopened within 14 days. Opened/used products cannot be returned.

    Secondly, if a game is faulty, you may return it under warranty (see below). Once we have verified the game is faulty, we will offer you a choice between a replacement copy or a full refund (again, not including any postage costs you may have incurred).

    Downloaded games may only be refunded as covered by warranty (see below). We are obliged to ensure that you receive your downloaded games. After that, if you delete or otherwise lose a downloaded game, you can download it again without having to buy a new product key. This replacement download service is offered as a courtesy (see below).

    Warranty

    Below is a copy of our standard warranty. Please note that it is included for your convenience only and that the warranty for some games may differ.

    Feral Interactive Ltd. guarantees to the original buyer of the multimedia product that the digital video disc (DVD) supplied with this multimedia product shall not show any fault during a normal-use period of ninety (90) days from the invoiced date of purchase, or any other longer warranty time period provided by applicable legislation.

    This warranty is invalid if the disc has been damaged through negligence, accident or misuse, or if it has been modified after acquisition.

    Please state your full name and address (including postcode), as well as the date and location of purchase.

    If a disc is returned without proof of purchase or after the warranty period has expired, Feral Interactive Ltd. will choose either to repair or to replace it at customer expense.

    The User recognizes expressly that he uses the multimedia product at his own risk. The multimedia product is provided as is, without any warranty other than what is laid down above. The User is responsible for any costs of repairing and/or correcting the multimedia product.

    To the extent of what is laid down by law, Feral Interactive Ltd. and its licensors reject any warranty relating to the market value of the multimedia product, the User's satisfaction or its capacity to perform a specific use.

    The User is responsible for all risks connected with lost profit, lost data, errors and lost business or other information as a result of owning or using the multimedia product. As some legislations do not allow for the aforementioned warranty limitation, it is possible that it does not apply to the User.

    Liability

    Feral Interactive Ltd. bears no responsibility for:

  • Any physical or mental trauma or injury caused by one of our games.
  • The loss or misuse of user data that occurs as the result of a malicious attack on any of our online services, including store accounts.
  • Reimbursement for purchases made fraudulently or as a result of such attacks.
  • Feral Interactive retains responsibility for any fraudulent claims or representations made by the company as well as death, personal injury or mental anguish caused by its negligence or willful misconduct. The laws of some countries preclude or disallow some or all of the limitations described in these terms. If these laws apply to you, you may be exempt from some or all of these terms and you may have additional rights.

    Post-purchase services

    Please note that the following services are offered purely as a courtesy, and may be removed or discontinued at any time:

  • We will provide you with an online account history of your previous purchases, including product keys for downloads.
  • You will usually be able to repeatedly download any games you have bought, though we reserve the right to disable this service for any reason. This may occur due to abuse of the service or during periods when our servers are especially busy (for example, during the release of a new game).
  • Amendments

    We reserve the right to amend these terms at any time. A history of these changes is included below.
